Terms of Service
BadgeDay, a product of Sirens to Syntax LLC
Effective date: July 26, 2026 · Last updated: July 26, 2026
The short version
BadgeDay generates practice questions from documents you upload. You may only upload material you have the right to use, and you are the one who knows whether that is true. The questions are a study aid built by a machine from your own documents — check them against the citation, because we have no idea what is actually on your exam and we are not connected to your department or to any testing agency. We sell to individuals for their own preparation; BadgeDay may not be used to build or administer an examination for a department. You can cancel anytime and your access runs to the end of what you paid for; we do not give refunds.
The rest of this document is the full agreement.
1. Who this agreement is with
These terms are between you and Sirens to Syntax LLC, a Nebraska limited liability company ("we", "us"). They govern your use of BadgeDay at app.badgeday.com (the "Service"). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.
Our Privacy Policy explains what we collect and what we do with it, and forms part of this agreement.
2. Eligibility and your account
You must be at least 18 years old and able to enter a binding contract. You sign in with a link sent to your email address, so the security of your account is the security of your email — anyone with access to your inbox can reach your account. Keep it secure, and tell us promptly if you believe someone else has used your account.
Your account is personal to you. Do not share it, sell access to it, or let anyone else use it.
3. What you may upload
BadgeDay contains no study material of its own. Everything it generates comes from documents you supply, which makes what you upload the most important obligation in this agreement.
You may upload only documents you have the right to use this way. In practice that generally means your department's published standard operating guidelines, materials your promotional announcement names as public sources, and texts you have lawfully obtained. You represent to us that you have that right for everything you upload.
You may not upload:
- copyrighted or licensed standards, textbooks, or manuals that you do not hold the rights to use in this way;
- commercial promotional or hiring test materials — question banks, practice batteries, or examination products from a testing vendor;
- actual examination content, whether a live examination, a retired one under restriction, or anything you obtained in confidence;
- material you are under a duty not to disclose — sealed personnel records, protected health information, criminal investigation files, or anything similar;
- anyone else's personal information.
We do not inspect your documents to check any of this, and we are not in a position to: they are private to your account by design. That places the judgment with you. If we are told that material on the Service infringes someone's rights or should not be there, we may remove it or suspend the account holding it.
Your documents remain yours. You grant us only the limited permission needed to run the Service for you — to store your files, extract their text, generate questions from them, and show all of that back to you. That permission covers nothing else, ends when you delete the material, and does not let us use your documents to train models or to build anything for anyone else.
4. Individuals only
BadgeDay is sold to individual candidates preparing for their own promotion. This is a deliberate limit on the product, not an oversight, and it is a term of this agreement:
- You may not use the Service to create, assemble, administer, proctor, or score an examination for a department or any other organization.
- You may not export or reproduce questions generated for you in order to supply them to a department as examination material, or to distribute or resell them.
- There are no organizational, department, or team accounts, and one account may not be shared among candidates.
Studying with questions generated for you, alone or in a study group where each member has their own account, is exactly what the Service is for.
5. What the Service is, and what it is not
BadgeDay generates practice questions from your documents automatically, and every question carries a citation to the section it was drawn from. The citation exists so that you can check the question against your own document. We ask you to use it: a machine-generated question can be wrong, and the source you uploaded is the authority, not us.
We are not connected to your department or to any testing agency. Sirens to Syntax LLC is not affiliated with, endorsed by, or acting for any fire department, civil service commission, testing vendor, or standards organization. We do not know what is on your examination. Nothing in the Service is a prediction of examination content, and using it is not a guarantee of any score, of promotion, or of any other outcome.
Nothing generated by the Service is legal, medical, employment, or operational advice, and it is not a substitute for your department's own training, policy, or direction. Do not use practice questions as an operational reference on the fireground.
If a question looks wrong, tell us at grant@sirenstosyntax.com. Accuracy is the product, and we would rather hear it.
6. Payment, renewal, and refunds
Access to upload documents and run practice sessions requires an active plan. Current prices are shown at checkout before you pay. Payments are processed by Stripe under Stripe's terms; we never receive your card details.
- Monthly subscription. Renews automatically each month at the then-current price until you cancel. Cancel at any time from the billing portal inside the app.
- 90-day intensive. A single payment for a fixed 90-day period of access. It does not renew and does not become a subscription; access ends when the period does.
Refunds. Payments are non-refundable. If you cancel a monthly subscription, you keep access through the end of the period you have already paid for and are not charged again — we do not refund a partial month. The 90-day intensive is non-refundable once access begins. This is the whole policy; please do not subscribe if it does not suit you.
We may change prices. A change to a subscription price takes effect at your next renewal and we will email you before it does, so that you can cancel first if you prefer. If a payment fails, access may be suspended until it succeeds. Prices are exclusive of any applicable taxes.
Losing access does not delete anything. Documents you have already uploaded remain yours to read and to delete whether or not you have an active plan.
7. Acceptable use
You agree not to:
- attempt to access another account's documents, questions, or answers, or to circumvent the access controls that keep them separate;
- attempt to obtain the answer to a practice question other than by answering it;
- scrape, bulk-export, or systematically extract material from the Service, or use it through automated means beyond ordinary use in a browser;
- probe, load-test, or interfere with the Service or the infrastructure it runs on;
- upload malware, or content that is unlawful for you to hold or transmit;
- resell, sublicense, or provide the Service to third parties.
The Service, its software, and its interfaces remain ours. These terms grant you the right to use it, not any ownership of it.
8. Availability
We aim to keep the Service running and available but do not promise uninterrupted service. We may take it down for maintenance, change how features work, or retire features. If we discontinue the Service entirely, we will give account holders reasonable notice by email and time to export or delete their material.
Document processing depends on third-party services, and a document that cannot be read — a scan of poor quality, an unusual format, a file that is corrupt — may fail to produce questions. That is not a defect in the Service and does not entitle you to a refund.
9. Ending the agreement
You may stop at any time: cancel from the billing portal, or delete your account from the account screen, which removes your documents, questions, practice history, and sign-in identity, and cancels your billing first. Deletion is permanent and we cannot recover what it removes.
We may suspend or terminate an account that breaches these terms — in particular sections 3, 4, and 7 — or where we are required to by law. Where the circumstances allow it, we will tell you why and give you a chance to put it right first. If we terminate an account for a reason that is not your breach, we will refund the unused portion of what you have paid.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the questions the Service generates are accurate, complete, or suitable for your examination, that the Service will be uninterrupted or error-free, or that using it will improve your results. The citation on each question is provided so that you can verify it against your own source, and you are responsible for doing so.
11. Limitation of liability
To the fullest extent permitted by law, Sirens to Syntax LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or loss of data, arising out of or relating to the Service — including any examination result, promotional outcome, or employment decision — whether or not we were advised such damages were possible.
Our total liability for all claims relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
12. Indemnity
You agree to indemnify and hold harmless Sirens to Syntax LLC from claims, damages, and reasonable costs arising out of material you upload — in particular a claim that it infringes someone's rights or that you were not permitted to disclose it — or out of your use of the Service in breach of these terms.
13. Governing law and disputes
These terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved by writing to us will be brought in the state or federal courts located in Nebraska, and you and we consent to the jurisdiction of those courts. If you are a consumer, this does not deprive you of the protection of mandatory laws in your place of residence.
Please write to grant@sirenstosyntax.com first. Nearly everything is faster to fix than to litigate.
14. Changes to these terms
We may update these terms. If a change is significant we will email account holders before it takes effect, and the "last updated" date above will change. Continuing to use the Service after a change takes effect means you accept the updated terms; if you do not, cancel and delete your account.
15. General
If any provision of these terms is held unenforceable, the rest remain in force. Our not enforcing a provision on one occasion is not a waiver of it. You may not assign this agreement; we may assign it in connection with a merger or sale of the business. These terms and the Privacy Policy are the entire agreement between us about the Service.
